These Terms & Conditions ("Terms") govern your use of the website withatwistnj.com (the "Site") and the booking of bartending services from With A Twist LLC ("With A Twist," "we," "us"), a New Jersey limited liability company based in Neptune City, NJ. By using the Site or booking our services, you agree to these Terms.
1. Services
With A Twist provides mobile bartending services, including bar setup, cocktail service, and wine and beer service, for private and corporate events within our service area (Monmouth, Ocean, Middlesex, and Mercer County, New Jersey, and surrounding areas within approximately one hour of Neptune City, NJ).
2. Quotes, Bookings & Minimums
- All quotes are estimates until confirmed in writing.
- A minimum spend of $400 and a minimum guest count of 15 apply to all bookings.
- A booking is confirmed only when we have agreed on the date, scope, and price in writing (email is sufficient), and any required deposit has been received.
3. Alcohol
- With A Twist operates as a dry-hire bartending service: we do not sell, supply, or resell alcohol. The client purchases and provides all alcoholic beverages.
- We serve alcohol only to guests who are 21 years of age or older. We reserve the right to request valid photo identification from any guest and to refuse service to anyone who cannot provide it.
- We reserve the right to refuse or discontinue service to any guest who appears visibly intoxicated, and to stop alcohol service entirely if continuing would be unsafe or unlawful.
- The client is responsible for ensuring that alcohol service at their event is lawful at the chosen location (for example, complying with venue rules, municipal ordinances, and any permits the venue may require).
4. Client Responsibilities
- Provide safe, reasonable access to the event location for setup and breakdown.
- Provide accurate guest counts and event details.
- Purchase the agreed alcohol and any agreed supplies not included in your package.
- Ensure the conduct of guests; we are not responsible for guest behavior.
5. Payments, Cancellations & Weather
- Payment terms (deposit, balance, and accepted payment methods) are stated in your booking confirmation.
- Cancellation terms are stated in your booking confirmation. Deposits may be non-refundable once a date is reserved, as that date is removed from our availability.
- For outdoor events, the client is responsible for a weather contingency plan. We will work with you in good faith to reschedule where possible.
6. Limitation of Liability
To the maximum extent permitted by New Jersey law, With A Twist LLC's total liability arising out of or related to any event or these Terms shall not exceed the total amount paid by the client for the services. We are not liable for indirect, incidental, or consequential damages. Nothing in these Terms limits liability that cannot be limited by law.
7. Website Use
The Site and its content (text, images, logos) are the property of With A Twist LLC or its licensors and may not be copied or reused without permission. The Site is provided "as is" without warranties of any kind. We may update the Site and these Terms at any time; changes take effect when posted on this page.
8. Governing Law
These Terms are governed by the laws of the State of New Jersey. Any disputes shall be resolved in the state or federal courts located in New Jersey.
